Apple sued by troll for packaging a headset with its phones

It’s official, the patent system is properly broken. As noted by GigaOM, the US Patent Office had released a statement saying there was nothing wrong with the system, telling the people who thought otherwise to “give it a rest”. As if we needed more evidence than the last couple of years worth of patent infringement suits, here’s a classic for you.

A shell firm in California has filed an infringement suit against Apple, asking for $3 million in damages because Apple packaged a headset with the iPhone. The patent is named “Wireless Mobile Phone Including a Headset” or US Patent 7,373,182. Incredibly general, and a fine example of a patent troll doing what it does best: trying to get money for coming up with an idea that is common sense. I mean, seriously, headsets are packaged with almost every single mobile phone out there. But, the troll, Intelligent Smart Phones Concepts LLC (which – by the way, doesn’t manufacture or produce anything at all) is singling out Apple.

GigaOM speculates that this company is one run by a large, and well know patent troll, Intellectual Ventures owned and run by a former Microsoft employee. Sadly, this company makes a living from suing everyone for everything and sometimes wins.

Now, how about a patent system reform?

    I love my Apple products but not the company I buy them from. If anyone is a troll it’s Apple. Suing people who are doing better than them to knock them down a few pegs. That’s sad. Let me feel bad for a multi billion dollar company

    I think what you’re failing to see, is that if this lawsuit is successful, they can sue absolutely any company that happens to ship a headset with its phones. Just in case you weren’t sure: that’s pretty much every manufacturer, ever.

    So NOW the system is broken? Forget the number of senseless lawsuits Apple started up. Apple getting sued for something that is “common sense” sounds like you may be defending logic that Apple has already rejected. How many things have Apple sued for being common sense. Rectangles anyone?

    @BillThomas thats not true. I like android, yet have both an iPhone AND an iPod. Its a pretty big assumption to make, that just because you’ve used an apple product that you HAVE to like it as well.

    @BillThomas  @TiP_Cam First of all, liking Android doesn’t automatically make one a “fanboy”. Secondly, of course most people will recognize the irony/hypocrisy of a company, that for the better part of this past year has been patenting extremely broad and trivial aspects of a smartphone, to finally be sued on similar grounds. Granted, what this “troll” company is doing is wrong – suing Apple over a trivial and nonsensical patent – but what we “fanboys” are saying is that Apple has no right to complain, since that is exactly what they’ve been doing.
