Just when you were beginning to miss the court cases, they are back. That’s right, more Apple vs. Samsung news for you, this one having to do with the $1.05 billion trial that happened in the United States. According to a new ruling from Judge Koh, $450 million of the damages awarded to Apple will be retried, as per the following quote from the ruling:
Because the Court has identified an impermissible legal theory on which the jury based its award, and cannot reasonably calculate the amount of excess while effectuating the intent of the jury, the Court hereby orders a new trial on damages for the following products: Galaxy Prevail, Gem, Indulge, Infuse 4G, Galaxy SII AT&T, Captivate, Continuum, Droid Charge, Epic 4G, Exhibit 4G, Galaxy Tab, Nexus S 4G, Replenish, and Transform.
Those 14 devices will be tried again, and with the damages removed it leaves the current total at $600 million. That most likely will go up though as a new jury will see the case for the devices listed above, and proceed with a new number for the damages of those devices. Now, to be clear, the ruling does not throw out the decision that these devices infringe on patents, only the amount of damages owed for those devices. So the ruling that the above devices infringed on patents still stands. Apple has declined a comment to AllThingsD and Samsung has yet to respond.
